Everyone’s against Apple: Motorola’s patent lawsuit

Another day means another act in the increasingly common patent claims. Motorola has decided to give another battle to Apple in court:  this time on the iPhone 4S and (for some extension) icloud service from Apple. Motorola claims that Apple violates six patents concerning its phones with the iPhone 4S. Among those who have patents for “having an external hidden antenna” and “apparatus for controlling the use of software added to a portable communication device”.

Motorola filed a lawsuit against Apple only after receiving approval from Google. A clause in the acquisition of the company from Google states that the mobile phone maker can not participate in patent lawsuits without prior approval from Google. Motorola originally wanted to bring these claims in a lawsuit filed in 2010, but could not because the law was already too advanced.

Apple has been behind the Android handset manufacturers in patent disputes, going so far as to win a lawsuit against HTC which will prevent the smartphone manufacturer to sell its phones in the United States since the end of this year. So far Apple has not directly attacked Google in any of its patent troubles, preferring to focus on the manufacturers of these devices in what amounts to a war for the possession of the patent.

In the lawsuit against Apple, Motorola could lead to a ban on the iPhone and icloud service in the United States, although it is possible that Motorola and Apple could reach an agreement. We have to wait and see how it handles the case in court.
